No warranty
CourtOn is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure or error-free.
You play at your own risk
Tennis involves physical risk. CourtOn is a scheduling and administration tool only. We do not organise, supervise, referee, insure or inspect any court, venue, group activity or tournament listed on the platform. Participation is entirely at your own risk, and organisers and players are responsible for their own safety, insurance, first aid and compliance with venue rules and local law.
Groups, clubs and organisers are independent
Clubs and group admins are independent third parties. They alone are responsible for their content, entry fees, prize money, refunds, eligibility rules, scheduling, cancellations, venue bookings, taxes and any dispute with their members. CourtOn is not a party to any agreement between an organiser and a player.
Payments
Any entry fee, cash payment, promotional code or offline settlement recorded in CourtOn is a record kept for the organiser's convenience. Unless a payment is processed by our payment provider, no money passes through CourtOn and we cannot arbitrate, reverse or guarantee it.
Limitation of liability
To the maximum extent permitted by law, CourtOn, its owner, operators and contributors are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of profits, revenue, data, goodwill, injury, property damage or business interruption arising out of or related to your use of the platform — whether based in contract, tort, negligence, strict liability or otherwise, and even if we were advised of the possibility of such damages.
Liability cap
Where liability cannot be excluded, our total aggregate liability for all claims relating to the service is limited to the amount you paid to CourtOn in the three months immediately preceding the event giving rise to the claim, or USD 100, whichever is lower.
Indemnity
You agree to indemnify and hold harmless CourtOn and its operators from any claim, demand, loss or expense (including reasonable legal fees) arising from your content, your events, your use of the platform, or your breach of these terms or of any law.
